An Esgenoôpetitj First Nation band councillor facing sex charges has chosen to be tried by judge alone.

Jason Dean Barnaby was in Miramichi provincial court Monday, charged with three counts of administering a noxious substance and one count of sexual assault.

Brunswick News repeatedly attempted to contact the Esgenoôpetitj band office to learn whether Barnaby is still active as a band councillor, but did not receive a reply.

His next court appearance was scheduled for April 8.
